I own a 50cc Honda Metropolitan scooter. Last weekend I thought it would be fun to ride with two people despite it having a seat made for only one, so I took it on a back-road and pushed myself to the very front of the seat so my g/f could ride in back (we’re both petite and our combined weight is about 280lbs.).

Amazingly…the scooter still managed about 35mph with us both…only 2mph slower than the 37mph I can go on it with just myself riding…despite substantially slower acceleration and worse braking ability (I treated it as if I was riding in rain). I was also light on the engine during acceleration b/c I didn’t want to risk the engine’s over-heating.

My real question is….can a police man actually pull me just over for taking a second person on such a small scooter…and/or are there any other issues I should be aware of?

How come a Honda Elite 80cc scooter max speed is 42mph on a flat and a stock 50cc scooter can go about 40mph on a flat?

I am thinking of buying a scooter which has been brought from out of state. I would like to know if the 80cc engine needs to pass emissions standards in California, and I was also wondering if I can ride the honda elite with just a regular license or do I need to get an M1 or M2 license or if I can just ride it with a permit. I was also hoping that you can post links which support your answer, hopefully from either CHP or DMV. I can not seem to find it on there.
